V\u00e1squez, Associated Press<\/p>\n<\/div>\n<\/div>\n<\/figure>\n<p>The Colorado Supreme Court has ruled that former President Donald Trump is ineligible for presidential candidacy and said it would be a \u201cwrongful act\u201d to include him in the state\u2019s 2024 ballot.<\/p>\n<p>The court said in its <a class=\"Link\" href=\"https:\/\/www.courts.state.co.us\/userfiles\/file\/Court_Probation\/Supreme_Court\/Opinions\/2023\/23SA300.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a> that Trump was in violation of Section 3 of the 14th Amendment, which bars from office anyone who has participated in insurrection against the Constitution. The unsigned majority opinion cites Trump\u2019s involvement in the infamous Jan. 6 insurrection, alleging the speech he gave to crowds prior to their attack on the Capitol incited the event. <\/p>\n<div class=\"RelatedList Enhancement\" data-module data-align-center>\n<div class=\"RelatedList-title\">Related<\/div>\n<ul class=\"RelatedList-items\">\n<li class=\"RelatedList-items-item\">\n                    <a class=\"Link\" href=\"https:\/\/www.deseret.com\/2022\/1\/5\/22864742\/jan6-insurrection-anniversary-us-capitol-donald-trump-political-violence-election-integrity-mike-lee\" target=\"_blank\" rel=\"noopener\">What have we learned? Lessons from the Jan. 6 insurrection <\/a>\n                <\/li>\n<\/ul>\n<\/div>\n<p>\u201cWe conclude that the foregoing evidence, the great bulk of which was undisputed at trial, established that President Trump engaged in insurrection,\u201d the opinion states.&nbsp;<\/p>\n<p>The case reached the state\u2019s Supreme Court after a district court ruled in November that Trump had participated in insurrection but did not remove him from the ballot. <\/p>\n<p>Tuesday\u2019s 4\u20133 ruling marks the first time in history that anyone has been barred from presidential candidacy because of the 14th Amendment, per <a class=\"Link\" href=\"https:\/\/apnews.com\/article\/trump-insurrection-14th-amendment-2024-colorado-d16dd8f354eeaf450558378c65fd79a2\" target=\"_blank\" rel=\"noopener\">The Associated Press<\/a>. <\/p>\n<p>\u201cWe do not reach these conclusions lightly,\u201d the court\u2019s majority wrote. \u201cWe are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach.\u201d<\/p>\n<p>The court will stay its ruling until Jan. 4, 2024, at which point it will go into effect unless it has been appealed.<\/p>\n<p>Trump campaign spokesman Steven Cheung released a statement shortly after the court announced its ruling, making it clear that Trump intends to challenge the decision. <\/p>\n<p>\u201cThe Colorado Supreme Court issued a completely flawed decision tonight,\u201d the statement read, \u201cand we will swiftly file an appeal to the United States Supreme Court and a concurrent request for a stay of this deeply undemocratic decision.\u201d <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former President Donald Trump speaks during a rally Sunday, Dec. 17, 2023, in Reno, Nev.
